You can't manufacture advanced semiconductors without a blueprint. But protecting that blueprint has historically been a massive headache for domestic tech companies.
Beijing just changed the legal battlefield. Premier Li Qiang signed a decree overhauling China's regulations on integrated-circuit layout designs. These revised rules span 54 articles across six chapters. They take effect on October 15, 2026, replacing an outdated framework that dates all the way back to 2001.
If you think this is just boring bureaucratic housekeeping, look closer. This update is a direct response to intense geopolitical pressure and supply chain restrictions. When you can't freely import advanced manufacturing machinery due to foreign export controls, your local chip designs become your most valuable corporate asset. China is drawing a hard legal line around that intellectual property.
What Actually Changes Under the New Regulations
The old rules were written when the local semiconductor sector looked entirely different. Back then, very-large-scale integrated circuits weren't driving entire hardware ecosystems like they do today.
The updated framework introduces teeth. Most notably, it establishes punitive damages for serious infringement. If a competitor steals or illegally mimics a proprietary integrated circuit layout design, the financial penalties are no longer a mere slap on the wrist. They sting.
The application and examination procedures got a major overhaul, too. Authorities are cracking down hard on fraudulent filings. Applicants now have to clear much higher evidentiary bars. You must submit a formal declaration of originality and explicitly identify the unique elements of your layout in the materials lodged with the China National Intellectual Property Administration (CNIPA).
Stop treating chip layout filings like routine paperwork. The state wants proof that genuine engineering effort went into the creation.
The Strategic Shift Toward Design Resilience
Why does this matter right now? Simple. Domestic firms are pouring billions into custom architectures and specialized software-hardware co-design strategies—similar to what Huawei has leaned on to navigate hardware bottlenecks.
When manufacturing physical chips gets harder, companies pivot toward smarter layouts and architectural innovations. But design work is expensive. It takes years of engineering hours and millions of dollars. If copycats can reverse-engineer or steal those layouts with impunity, the incentive to innovate completely vanishes.
By clarifying co-ownership rights, licensing rules, and transfer protocols, these regulations make it easier for local firms to commercialize their intellectual property without fear of internal theft or unauthorized leakages.

- Prepare for severe penalties: Infringement risks are escalating rapidly. Statutory damage caps and punitive measures mean legal exposure is higher than ever.
