Consider what happens next for thousands of workers caught in this machinery between 2020 and 2022. To the software running the background calculations, a driver taking an unexpected detour to navigate a sudden street protest or accepting a trip they ultimately cannot complete looks less like a human navigating urban chaos and more like an anomaly. The legal principle at stake is deceptively simple. Under European privacy statutes, no person should be subjected to a decision based solely on automated processing—including profiling—that produces legal effects concerning them or similarly significantly affects them. When a platform serves as the sole gatekeeper to a person's ability to earn a living, an algorithm deciding to lock them out is not a minor software glitch. It is an economic execution.

The investigation began quietly, sparked by complaints from French drivers who found themselves locked out of their accounts on suspicion of fraud. Because Uber bases its European headquarters in Amsterdam, the Dutch regulator took the lead, unspooling a history of automated policies that operated with terrifying efficiency. Software flagged unnecessary detours. Software flagged incomplete trips. Sometimes, dipping customer ratings triggered permanent deactivations without a single human eye ever verifying if a mistake had occurred.

Uber argues that the fine is disproportionate and points out that the contested policies were historical, modified years ago. A company spokesperson emphasized that the platform takes driver rights seriously, noting that current operational frameworks involve human reviews and pathways to appeal. The corporation maintains that it never permanently deactivated accounts through pure automation alone.
